Eligibility: The ResMed Climate Control drawing (the “Promotion”) is open only to legal residents of North and South America; who are eighteen (18) years of age or older or the age of majority in their state or country of residency, whichever is older; and who are employees of a home medical equipment provider, sleep center, sleep center hybrid, or other provider of medical equipment or care, as of October 1, 2011. Void where restricted or prohibited by law, rule or regulation. Employees, officers, directors, representatives and agents of ResMed Corp., (“The Sponsor”) and their respective parents, subsidiaries & affiliated companies, advertising, promotion and administrative agencies and their immediate families (spouse, parent, child, sibling and their respective spouses) and those living in the same household, whether or not related, are not eligible to enter or win. The Promotion is subject to all federal, state and local laws, rules and regulations.
How to Enter: The Promotion begins at 12:01 AM Central Time (“CT”) on October 1, 2011and ends at 11:59:59 PM CT on December 1, 2011 (“Entry Period”). There are two components to the Promotion: the free tube registration (“Free Tube”) and the Grand Prize Drawing (“Grand Prize”).
In order to be entered for the Free Tube or Grand Prize, a contestant must complete a registration form. Supplies for the Free Tube are limited and will be distributed on a first-come, first-served basis until supplies run out. All eligible registrants will be automatically entered into the Grand Prize drawing for one of four $500 American Express gift cards.
Prizes: Free Tube Prizes: Each eligible Free Tube winner will receive a ClimateLine tube. The ClimateLine tube may not be dispensed to anyone who is not a licensed health care professional or employee of a home medical equipment provider, sleep lab, sleep lab hybrid or other dispenser of home medical equipment or care. Winners may not seek reimbursement of any ClimateLine tube from US Federal or State agencies. A valid prescription is required on masks, devices and heated tubing for patient use. Total Approximate Retail Value (“ARV”) of each Free Tube is: $66.00.
(4) Grand Prizes: The Grand Prize (defined below) will be randomly awarded at the end of the Entry Period from among all eligible registrants. Four (4) Grand Prize winners will win one $500 American Express Gift Card. Approximate retail value of Grand Prize is: $2000.00.
Limit of one (1) prize per person, which will be verified by address. All prizes are expressly limited to the items listed and do not include any other accessories, services or additional expense. Any difference between the actual cost and the approximate retail value will not be awarded. The prizes are non-transferable, non-assignable, and are not refundable, and must be accepted as awarded. No cash or other substitution may be made, except by The Sponsor, who reserves the right (but has no obligation) to substitute a prize (or a component thereof) with another prize (or component thereof, including cash) of equal or greater value if the prize is not available for any reason as determined by Sponsor in its sole discretion. Winners are fully responsible for any and all applicable federal, state, international and local taxes and assessments.
Winner Selection and Notification. Prizes will be awarded in one of two ways: (i) instantly upon entry (Free Tube), and (ii) upon random drawing among eligible registrants (Grand Prize).
Free Tube Prizes. All eligible contestants who complete the brief registration, subject to verification, will receive a Free Tube until supplies are depleted. The Sponsor has allocated 500 tubes for the promotion, but although Sponsor is not obligated, Sponsor may in their sole discretion fulfill additional registrations if supplies allow. Free Tubes will be mailed to eligible winners within 4-6 weeks following conclusion of the verification process.
AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY AND ENTRANT’S COMPLIANCE WITH THESE OFFICIAL RULES HAVE BEEN VERIFIED BY SPONSOR AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.
Random drawing. The Grand Prize winners will be randomly selected on or about December 2, 2011 from among all eligible entries received during the Entry Period. Odds of winning depend on the total number of eligible entries received.
Prize winners will be notified by mail, email or telephone at the email, address or phone number provided during entry. Grand Prize winners will be required to execute and return an Affidavit of Eligibility, Release of Liability and, where legal, Publicity, within seven (7) days of prize notification, or the prize will be forfeited. If a winner is found to be ineligible, or does not comply with these Official Rules, that winner will be disqualified, the prize will be forfeited and an alternate winner may be selected.
General Conditions: By participating, each entrant agrees to be bound by these Official Rules and the decisions of Sponsor and waive any right to claim ambiguity in the Promotion or these Official Rules. By entering, each entrant agrees that The Sponsor, and each of their respective affiliate companies, parents, subsidiaries, and all of their respective officers, directors, employees, representatives, and agents shall not be responsible and will have no liability whatsoever for losses or injuries of any kind resulting from participation in this Promotion including, but not limited to: any injury or damage to person or property which is part of or related to any prize; the acceptance/possession and/or use/misuse of any prize; any injury or damage to entrant’s or third person’s property related to or resulting from any part of the Promotion; or any technical malfunctions of, or non-authorized human intervention (“hacking”) into, the entry system including computer online system, dating mechanism, software, or any combination thereof. The Sponsor shall have no liability for any incomplete or late entries or entries not in compliance with these Official Rules, and such entries will be disqualified. Sponsor, as applicable, reserves the right, in their sole discretion, to cancel, terminate, suspend, or modify this Promotion (or any portion thereof) for any reason including but not limited to a virus, bugs, non-authorized human intervention or other cause which corrupts or impairs the administration, security, fairness, or proper play of the Promotion (or any portion thereof). In such event, winners will be selected in a manner determined by The Sponsor, deemed to be fair, appropriate and consistent with the spirit of these Official rules. If due to a production or other error, more winning Official Game Notices are distributed, or more prizes are claimed than are intended to be awarded, the intended prize(s) will be awarded in a random drawing from among all verified claims received. In no event will sponsor be obligated to award more than the stated number of prizes. Notice of such action will be posted at www.ResMed.com.
CAUTION: ANY PERSON(S) ATTEMPTING TO DEFRAUD OR IN ANY WAY TAMPER WITH OR DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THE PROMOTION IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR WILL DISQUALIFY SUCH PERSON(S), AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER LEGAL OR EQUITABLE REMEDIES FROM ANY SUCH PERSON(S) TO THE FULLEST EXTENT PERMITTED BY LAW.
Entries generated by a script, macro or other mechanical or automated means will be disqualified. All online entries must include a valid email and mailing address for the entrant. In the event of dispute as to the identity or eligibility of any winner based on an email address, the winning entry will be declared made by the “Authorized Account Holder” of the email address submitted at the time of entry provided he/she is eligible according to these Official Rules. The “Authorized Account Holder” is defined as the natural person to whom the applicable Internet service provider or other organization (such as a business or educational institution) has assigned the email address for the domain associated with the submitted email address.
